Remote maintenance

Scope of services of EsCulenta GmbH

  • The subject of this agreement is remote maintenance work on the customer's IT system. This serves the maintenance or troubleshooting of the software and hardware used by the customer.
  • The remote maintenance service is only carried out at the request of the customer. Remote maintenance work is provided at the discretion of EsCulenta GmbH by making maintenance software available or by having a staff member of EsCulenta GmbH perform the maintenance.
  • Personal data that becomes known to EsCulenta GmbH in the context of remote maintenance will only be used for the purposes of the remote maintenance service and, in the case of chargeable remote maintenance support, for the purpose of invoicing. There will be no transfer of this data to third parties.
  • Personal data required for invoicing will be removed after the statutory retention period.

Obligations of the customer

  • The customer undertakes to use only the software deployed by EsCulenta GmbH for the remote maintenance sessions. Any damages arising from a violation of this obligation will be borne by the customer.

Technical and organisational security measures

  • The establishment of the remote maintenance connection only takes place in coordination with the customer. After the remote maintenance work is completed, the connection will be terminated immediately.
  • The customer grants EsCulenta GmbH the necessary rights for remote maintenance via the deployed remote maintenance solution. The customer has the right and the option to disconnect the remote maintenance session at any time.

Liability and compensation

EsCulenta GmbH is liable for intent and gross negligence as well as for guaranteed properties according to statutory provisions. Liability for simple and moderate negligence is excluded.

EsCulenta GmbH cannot be held liable for damages caused by potential operational interruptions or a temporary unavailability of the software. In this respect, liability for damages is also limited to simple and indirect negligence caused by third-party components that are outside the influence of EsCulenta GmbH.

Security and Storage

We have technical and organisational security procedures in place to ensure the security of your personal data and to protect against unauthorised or unlawful processing and/or against accidental loss, alteration, disclosure or access. Your data is password protected on all systems where it is stored. Those who have access to it are prohibited from disclosing your data to third parties by strict security requirements.

We only retain your data for as long as is necessary in relation to the purpose.
